People based outside Chiang Mai or abroad frequently ask whether they can sign a property transaction through a Power of Attorney rather than attending in person. The answer is yes — but it must be done correctly.
What Is a Power of Attorney (POA)?
A POA is a legal document that allows a property owner or buyer (the grantor) to authorize another person (the attorney-in-fact) to conduct legal matters on their behalf within defined limits.
Types of POA in Chiang Mai Real Estate
1. Specific POA — grants authority for a defined transaction only (recommended, safer)
2. General POA — broad authority covering multiple matters (higher risk)
POA Process for Thai Nationals in Thailand
1. Complete the Land Department POA form (TorDor 21)
2. Sign in front of 2 witnesses
3. Affix stamp duty as required
4. Present at the Land Department
POA Process for Thai Nationals Abroad
1. Complete the Land Department POA form
2. Have it certified at the Thai Embassy or Consulate
3. Or notarize at a Notary Public and obtain an Apostille
4. Send documents back to the attorney-in-fact in Thailand
POA Process for Foreigners
1. Prepare a POA through a lawyer
2. Notarize at a Notary Public
3. Obtain Apostille from the relevant authority
4. May require certified Thai translation
Key Cautions
- Grant authority only to someone you genuinely trust — agent, lawyer, or trusted family member
- Define the scope of authority clearly — e.g., transfer specifically this land at no less than X baht
- Never grant broader authority than necessary
- Stamp duty is required — without it the POA is incomplete
- Set a clear expiry date — recommend no more than 6 months
