Standard Commission Rates in Chiang Mai

For sales: 3-5% of actual sale price. TREBA recommends 3% as the standard minimum. High-value properties (THB 20M+) may negotiate down to 2-3%.
For rentals: 1 to 1.5 months' rent, depending on lease duration and workload involved.

Who Pays the Commission

For sales: Thai standard practice is the seller (property owner) pays the full commission. If two agents are involved (Co-broke), they split between themselves but the total is still charged to the seller.
For rentals: Generally the property owner pays; in some cases the tenant pays half, depending on market conditions and agreement.

Services That Should Be Included in Commission

A professional agent should include: professional photography (including drone where appropriate), writing and listing on all channels, arranging and conducting property viewings, negotiating on behalf of the seller, helping prepare transfer documents, and advising throughout the process.

Questions to Ask Before Signing an Agency Agreement

1. What is the commission rate and what exactly is included?
2. Are there additional costs beyond commission (photography, advertising)?
3. What is the duration of the agency agreement?
4. On which channels will the property be listed?
5. What happens if the property doesn't sell within the specified period?

Warning Signs of a Poor-Quality Agent

Suspiciously low commission with no real service; charging separately for photography or advertising that should be included; no agent license; no reporting or tracking system for the property owner

Recommendation: An appropriate commission and a genuinely capable agent is more valuable than saving slightly on commission and getting an agent who doesn't perform or achieves a lower sale price than the property deserves.
