Tenant Rights in Chiang Mai — What Can and Cannot a Landlord Do?
Both tenants and landlords in Chiang Mai should clearly understand their rights and obligations under Thai law to prevent unnecessary problems and disputes.
Basic Tenant Rights Under Thai Law
1. Right to peaceful occupation for the full lease term — landlords cannot evict before the contract ends without legal grounds
2. Right to use the property for the agreed purpose
3. Right to receive the property in working condition — landlords must repair major system failures not caused by tenant negligence
4. Right to deposit refund — when the lease ends and property is in normal condition, the landlord must return the deposit within the agreed timeframe
What Landlords Can Legally Do
Permitted
- Collect rent as specified in the contract
- Raise rent when renewing a new contract (not during an existing one)
- Deduct from deposit for damage caused by the tenant
- Inspect property condition with advance notice
- Choose not to renew when the contract expires
What Landlords Cannot Do Under Thai Law
Strictly prohibited
- Raising rent during the contract term without consent
- Cutting water, electricity, or otherwise obstructing the tenant's life to force them out
- Entering the property without tenant permission (except genuine emergency)
- Seizing or destroying the tenant's personal property
- Threatening or harassing the tenant to vacate

3. If unresolved, file with the court
4. Wait for a court judgment before taking any further action
