Chiang Mai Real Estate and Escrow Systems — Buyer Money Protection Options Worth Knowing in the Modern Era

Many property buyers don't realize they have more options for protecting their money than they think — especially when buying from a developer.

What Is Escrow and How Does It Work

Escrow is a system where a trusted third party (bank, law firm, or financial institution) holds the buyer's money instead of transferring it directly to the seller immediately. The money is released to the seller only when all contractual conditions have been fully fulfilled.

Escrow Status in Thailand

The Business Escrow Act B.E. 2551 exists, but real-world use in the general property market remains limited. Some banks and law firms do provide Escrow services for real estate transactions.

Why Escrow Isn't Common in Chiang Mai Generally

Additional cost: Escrow service fees typically 0.1-0.5% of transaction value; limited familiarity: most buyers and sellers aren't familiar with the process; market structure: second-hand sales typically go through the Land Department which has its own verification system

Available Money Protection Alternatives in Chiang Mai

1. Conditional deposit held by a neutral lawyer: Deposit held by a neutral lawyer (not transferred directly to seller); lawyer releases money when all contract conditions are met; preferred for high-value or complex deals

2. Simultaneous transfer at the Land Department: Standard Thai method — buyer, seller, and bank (if financed) complete the transaction simultaneously at the Land Department; money transfers to seller simultaneously with title transfer

3. Bank-mediated payment with mortgage financing: Bank naturally acts as intermediary when buyer borrows; loan funds transfer directly to seller without passing through the buyer

4. Lawyer-supervised process: Lawyer engaged to verify documents and oversee the transfer — not true Escrow but reduces risk from incorrect documentation

For Pre-Sale Developer Purchases

Highest risk period is during down payment instalments before completion. Best protection: verify that the project has bank support — this signals the bank has already conducted developer due diligence.
