Thai-Foreign Couples and Chiang Mai Property Ownership — Rights and Correct Planning

Thai-foreign couples are one of the most common client groups in the Chiang Mai real estate market. Understanding rights and planning correctly from the outset prevents many future problems.

Why Thai-Foreign Couples Need Special Care

Thai law does not permit foreigners to hold land in their own name, and special requirements apply when one spouse is a foreign national. Incorrect planning can create serious legal problems later.

Case 1: Thai spouse buys land or house in their name alone
The most legally straightforward approach. Required: The foreign spouse must sign a statement confirming the purchase funds are the Thai spouse's personal property, not joint marital assets. Risk: If the couple separates, the foreign spouse has no official rights to the property.

Case 2: Thai spouse buys using joint marital funds
A consent letter must confirm the foreign spouse consents to the purchase and acknowledges they have no rights to the land.

Case 3: Freehold Condo in the foreign spouse's name
Directly possible within the 49% foreign quota. The foreign national holds condo title directly — no need to use the Thai spouse.

Case 4: Freehold Condo in joint names
Not permitted. Freehold condos must be in one name only.

Common Problems and Prevention

Problem 1: Money transferred from overseas — when a foreign national transfers funds to buy property registered in a Thai spouse's name, tax and legal complications can arise. Prevention: Consult a lawyer before transferring, prepare clear documentation.

Problem 2: Divorce and property rights — if the foreign spouse contributed financially but has no name on the deed, rights may be unclear. Prevention: Prepare a Pre-nuptial Agreement or Cohabitation Agreement specifying rights clearly.

Problem 3: Inheritance when one spouse passes — foreigners may not be able to directly inherit land. Prevention: Plan inheritance with a lawyer in advance.

Recommendations for Thai-Foreign Couples

1. Always consult a lawyer specializing in foreign national law before any purchase
2. Document everything clearly and formally
3. Consider Freehold Condo in the foreign spouse's name as the simplest option
4. Plan inheritance alongside property purchase
