Overlapping Land and Boundary Disputes in Chiang Mai — How to Verify and Protect Yourself Before Buying

Land overlap and boundary discrepancies are among the most serious problems property buyers can encounter — commonly occurring in recently developed areas or on land not surveyed for many years.

Why Land Overlap Problems Occur

1. Inaccurate historical surveys: Some title deeds were issued from imprecise historical surveys, meaning the deed map doesn't match the actual land
2. Environmental changes: Buildings, fences, or roads constructed later may encroach on neighboring land boundaries
3. Multiple ownership transfers: Land transferred many times may accumulate boundary data inconsistencies
4. Forest-edge or public land proximity: Land near forest reserves, public land, or government land carries higher risk

Verification Methods Before Buying

1. Request a Land Department survey (สอบเขต): Most accurate method — Land Department officers measure actual boundaries and compare to the title deed. Cost: approximately THB 3,000-10,000. This is the most reliable official document.

2. Compare deed map with Satellite Images: Compare title deed map against Google Earth or Google Maps to check boundary alignment; look for neighboring structures that may be encroaching

3. Inspect fences, boundary markers, and dividers: Check whether existing fences and markers match the deed map; ask neighbors about boundary history

4. Check at the Land Department: Request the parcel map showing adjacent land plots for comparison

Consequences of Buying Land With Boundary Problems

Litigation required to correct boundaries — time-consuming and expensive; property value decreases and becomes harder to resell; in some cases structures built beyond the boundary must be demolished

Recommended Contract Clause

The SPA should specify that if boundary problems are discovered after signing, the buyer has the right to cancel and receive the deposit back, or the seller must correct the issue before transfer.
