The Juristic Person (นิติบุคคลอาคารชุด) is the legal organization that manages a condo project. Many condo buyers don't fully understand how the juristic committee affects them.
What Is the Condo Juristic Person?
A legally established organization comprising: the Juristic Committee (owner-elected representatives) and the Juristic Manager (individual or company responsible for daily operations)
Main Responsibilities
1. Common area management: elevators, central electrical and water systems, pool, gym, gardens, security, shared parking
2. Collecting and managing common fees: collecting monthly payments and managing maintenance budgets
3. Enforcing building regulations: quiet hours, pool usage rules, Short Stay restrictions
Common Area Fee
Monthly charge proportional to unit size
Chiang Mai common fee rates:
Standard: THB 25-60 per sqm/month
Premium condo: THB 60-100 per sqm/month
Example: 40 sqm unit at THB 40/sqm = THB 1,600/month (THB 19,200/year)
Sinking Fund
Paid once at transfer — typically THB 500-1,000 per sqm
Reserved for future major structural repairs (new elevators, roofing etc.)
Pre-Purchase Checks
1. Outstanding common fee balance: Check if the unit has unpaid fees — new owners may inherit these
2. Juristic committee financial health: Review financial statements, is the reserve sufficient for repairs? Insufficient reserves mean future special levies
3. Key regulations: Read the regulations — especially Short Stay policy, pets, and unit modification rules
4. Maintenance history: Are common facilities well-maintained and regularly serviced?
5. Juristic Manager reputation: Is the manager credible and performing well?
