Thai-foreign married couples in Chiang Mai have several options when purchasing property. Each option has different advantages, disadvantages, and risks.

Key Marital Property Law Principles

Marital Property (Sin Somros): Assets purchased during marriage are jointly owned — both parties hold 50:50 rights and must jointly consent to any sale or transfer.

Personal Property (Sin Suan Tua): Assets owned before marriage or inherited — belong solely to that individual.

Situation 1: Condo in the foreigner's name
Condition: Foreign buyer purchases Freehold condo within the 49% foreign quota
Advantage: 100% legal — full foreign ownership
Required: Thai spouse must sign a Consent Letter confirming the money is the foreigner's personal property

Situation 2: Condo in the Thai spouse's name
Simplest approach with no legal complications
Disadvantage: Foreigner has no direct ownership
Important note: If purchased with joint money (marital property), foreigner may have rights to 50% of value in divorce proceedings even without being named on the title

Situation 3: Land or house in the Thai spouse's name
Land and houses can only be directly owned by Thai nationals
Foreigner must sign a waiver confirming the money is the Thai spouse's personal property
Key risk: If the foreigner funded the purchase but signed away rights, they may lose the asset if the couple divorces or the Thai spouse passes away

Situation 4: Joint condo ownership (both names)
Possible for condos within the foreign ownership quota
Both parties named in ownership — both must consent to any sale

Divorce and Property

Marital property is split 50:50 on divorce. Even if a property is in the Thai spouse's name only, if purchased with joint money it is marital property — the foreigner has rights to 50% of the value through the marital property division process.

Before any purchase: Consult a lawyer specializing in property and family law. Consider a Prenuptial Agreement to clearly define personal and marital property. Good documentation prevents future problems significantly.
